By visiting this website and/or purchasing from Sound Cycle, you are engaging in the "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including any additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, suppliers, customers, merchants, and/or content contributors.

Please read these Terms of Service carefully before accessing or using the website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all of the terms and conditions of this agreement, you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools added to the current store will also be subject to the Terms of Service. You may review the most current version of the Terms of Service at any time on this page. Sound Cycle reserves the right to update, change or replace any part of these Terms of Service by posting updates and/or modifications on this website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the web site following the posting of any changes constitutes acceptance of those changes.

1 - ONLINE STORE CONDITIONS

By accepting these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are of the age of majority in your state or province of residence and that you have given your consent to allow one of your dependent minors to use this site.

You may not use the Products for any illegal or unauthorized purpose or, in the use of the Service, violate the laws of your jurisdiction (including but not limited to copyright laws).

You may not transmit any worms, viruses or code of a destructive nature. Violation of any of the Terms will result in immediate termination of your Services.

2 - Studio policies

Age By using the Services, you represent that you are over 16 years of age. If you are between the ages of 16 and 18, your parent or guardian must have consented to these Terms and your use of the Services.
Credits To book a course, you must first purchase one or more course credits. To purchase credits online, you must register on the Site using an e-mail address and password. Payment for all courses must be made before the scheduled date to guarantee your place. All course packages are nominative and non-transferable. Identification may be requested at studio reception.
Reservation Courses must be booked in advance. Courses are available to book online 10 days before the course. The "Book a course" option allows you to reserve a place, and the "Add to waiting list" option allows you to join a waiting list if the course is full. Being on a waiting list implies a commitment to attend the course if a place becomes available. You will be notified by e-mail as soon as your place is confirmed.
Course access You must be physically present 5 minutes before the start of the lesson booked, otherwise your place may be allocated to a customer on the waiting list. If this is your first time, you must be at the studio at least 15 minutes before the start of the class. Entry is permitted up to 4 minutes after the start of the class. After that time, entry will no longer be permitted. All persons accessing the course agree to be bound by these Terms.
Cancellations Please note: If you are unable to attend a reserved class, please cancel your reservation to free up space for others. Courses can be cancelled without penalty up to 12 hours before the start of the course. In this case, your credit will be refunded and you can use it for another booking. This also includes slot changes within the 12-hour period. Cancellations must be made via our online system.
Personal effects You acknowledge that we are in no way responsible for the security of your personal belongings while you are at the studio. You assume all risk of loss of your personal belongings. Any locker not vacated by the end of the day will be opened by studio staff for security and hygiene reasons.
Gift cards and private events Gift cards can be used for courses or products, but cannot be exchanged for cash. Fees for private events are due at the time of booking and are non-refundable. All participants must accept these Terms before attending the event.
Service interruption Our facilities may be temporarily or permanently suspended without notice for reasons of security, maintenance, repair, system failure or other similar circumstances ("Service Interruption"). You acknowledge and agree that you are not entitled to any refund or compensation in connection with such Service Interruptions. In the event of a course cancellation, your credit will be refunded.

2.2 Credits and fees

Prices are in Swiss francs (CHF) and include VAT. Credits have an expiry date indicated on the Site's pricing page. If you fail to pay any fees or charges due, services or privileges may be suspended and/or terminated. You are responsible for all outside charges, including attorneys' fees and collection costs that Sound Cycle may incur to collect unpaid balances. Sound Cycle reserves the right to change its rates, offers and packages at any time at its discretion. Special discount codes communicated on social networks by our partners (or influencers) are valid for 30 days.

2.3. Refund policy

If you are a consumer as defined by the Code of Economic Law, you may cancel your online order for a course or online sale without giving any reason within 7 days of completing the purchase, provided you have not used the package purchased. You must inform us of your decision to cancel your order by contacting us at hello@soundcycle.ch. To meet the cancellation deadline, simply send your communication before the 7-day period expires. The refund will be made within 7 days of the date on which we were informed of your decision, by the same means of payment used for the initial transaction. Subject to the above, courses are non-refundable. No exceptions (including injury, illness, change of address). Unused items will be accepted for store credit within 7 days of purchase. No returns will be accepted without a receipt.

2.4. Intellectual property rights

The content of the Website and Apps, including, but not limited to, text, software, scripts, graphics, photos, sounds, music, videos, interactive features, and trademarks, service marks and logos contained on this site ("Content") are owned by or licensed to Sound Cycle, and are protected by copyright and other intellectual property rights under law. The Content is provided to you "as is" for your information and personal use only and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed or otherwise exploited for any other purpose without the prior written consent of the respective owners. We reserve all rights not expressly granted in the Website and the Content. You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other information on the Site or the Services provided by you to the Company are non-confidential and become the exclusive property of Sound Cycle. You agree not to use, copy or distribute any Content except as expressly authorized herein. You agree not to circumvent, disable or otherwise interfere with site security features or features that prevent or restrict the use or copying of any Content or impose limits on the use of the site or Content contained therein. By participating in Sound Cycle courses, you may be photographed or recorded by Sound Cycle or third parties authorized by Sound Cycle, as part of the production of content that Sound Cycle or such third parties may use for advertising, marketing and/or promotion of Sound Cycle and its services. You consent to the use of such images for any purpose by Sound Cycle and such third parties, and agree that Sound Cycle and such third parties shall in all circumstances be the sole owners of all intellectual property and other proprietary rights therein without restriction.

You are responsible for ensuring that the information provided at the time of registration or at any other time is accurate and complete. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device. You agree to accept responsibility for all activities that occur under your account and/or password. The data you provide to Sound Cycle will be processed in accordance with the Swiss Data Protection Act and the RGPD. The personal data we request from you, marked with * are mandatory to enable you to use the Services. If you do not complete these mandatory fields, we will not be able to process your request for an account or use of the Service. 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

Sound Cycle is not responsible if the information provided on this site is not accurate, complete or current. The material on this site is provided for general information purposes only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more current sources of information. Any reliance on the material on this site is at your own risk.

This site may contain historical information. Historical information, by necessity, is not current and is provided for your reference only. Sound Cycle is not a health professional and nothing on this website should be interpreted otherwise.

There may be risks associated with participation in the activities mentioned on Sound Cycle for persons in poor health or with pre-existing physical or mental health conditions. Because these risks exist, you will not participate in any of the nutrition or training programs available on Sound Cycle if you are in poor health or have a pre-existing physical or mental condition. If you choose to participate in these risks, you do so of your own free will and with full knowledge of the facts, voluntarily assuming all risks associated with such dietary activities. As with any training program, you assume certain health and safety risks. Any form of training program can cause injury, and the training programs offered by Sound Cycle are no exception. It is possible for you to injure yourself while performing the exercises in your program, especially if they are performed with poor form. While thorough form instruction is included for every exercise, be aware that Sound Cycle (like any other exercise program) involves a risk of injury. If you choose to participate in these risks, you do so of your own free will and with full knowledge of the facts, voluntarily assuming all risks associated with such exercise activities. These risks may also exist for those who are currently in good health.

Sound Cycle is not a doctor. Its advice, whether on its website, in its meal plans, workout programs or through email coaching, is not intended to replace medical advice. You should consult your physician before beginning ANY meal plan or exercise program, without exception. 5 - GENERALLY EXPECTED RESULTS

Although Sound Cycle products and services are intended to be fully implemented, sometimes they are not, which could result in a lack of progress/results for the user. If you implement Sound Cycle's products and services correctly, you should see amazing results, however, it must be made clear that even when consumers implement Sound Cycle's products or services correctly, it is still possible that they will not achieve the results they expect and it is also possible that they will not lose fat, gain muscle or achieve any positive results.

6 - DISCLAIMER ON TESTIMONIALS

All transformations and testimonials are real. However, it must be made clear that these testimonials are not intended to represent typical results with Sound Cycle's nutrition and training programs, they are intended to show what the most motivated and dedicated people can achieve by following the personalized nutrition and training programs. Your results may vary using Sound Cycle, and you may not achieve the same results as someone else using the services due to differences in your individual exercise history, genes, and personal motivation/determination. The final results you achieve will depend on the individual and the effort you put in.

7 - SERVICE AND PRICE CHANGES

Sound Cycle reserves the right to refuse any order you place with us. Sound Cycle may, in its sole discretion, limit or cancel quantities purchased per person, per household, or per order. 18 - DIVISIBILITY

If, in our sole judgment, you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we may also terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or as a result, we may deny you access to our Services (or any part thereof).

Sound Cycle's failure to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by Sound Cycle on this site or with respect to the Service constitute the entire agreement and understanding between you and Sound Cycle and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and Sound Cycle (including, without limitation, all prior versions of the Terms of Service).
